Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Tradefaire application and website (the “Service”) operated by Tradefaire (“we,” “us,” or “our”). By using the Service, you agree to these Terms and our Privacy Policy.
1. The Service
Tradefaire is a social commerce platform that enables buyers to discover and purchase products from independent sellers, and enables sellers to list products, receive orders, and fulfil shipments through integrated logistics. We are a marketplace — sellers are responsible for their listings unless we state otherwise.
2. Eligibility
You must be at least 18 years old and capable of entering a binding contract under Nigerian law. By using the Service, you represent that you meet these requirements.
3. Accounts
- You are responsible for keeping your login credentials secure;
- Information you provide must be accurate and kept up to date;
- Sellers may be required to complete identity or business verification before selling or withdrawing funds;
- We may suspend or terminate accounts that violate these Terms or applicable law.
4. Buyer terms
- Product descriptions and prices are set by sellers;
- Payment is processed through our payment partners; successful payment creates a binding order subject to seller acceptance where applicable;
- Delivery times are estimates; logistics partners may update tracking independently;
- Disputes and refunds are handled according to in-app policies and applicable consumer protection law.
5. Seller terms
- You must have the right to sell listed products and comply with Nigerian law;
- Listings must be accurate; prohibited items are not allowed;
- You must accept or decline orders within stated time limits (for example the 24-hour acceptance window);
- You are responsible for preparing packages for pickup by Tradefaire logistics partners;
- Fees, commissions, and payout schedules are disclosed in the app.
6. Payments and wallet
Payments are processed by third-party providers (such as Paystack). We do not store full card details. Wallet balances and withdrawals are subject to verification, fraud checks, and applicable fees displayed in the app.
7. Prohibited conduct
You agree not to:
- Use the Service for fraud, money laundering, or illegal activity;
- Post false, misleading, or infringing content;
- Interfere with the Service or other users’ experience;
- Scrape, reverse engineer, or abuse our APIs without permission;
- Circumvent fees or security measures.
8. Intellectual property
Tradefaire owns the Service, branding, and software. You retain rights to content you upload but grant us a licence to host, display, and distribute it as needed to operate the Service.
9. Disclaimers
The Service is provided “as is” to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation. We are not liable for seller conduct, third-party logistics delays, or events outside our reasonable control.
10. Limitation of liability
To the maximum extent permitted by law, Tradefaire is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim relating to the Service is limited to the greater of (a) amounts you paid us in the three months before the claim or (b) ₦50,000, except where law requires otherwise.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations, risk, or legal requirements. Provisions that by nature should survive (payment obligations, liability limits, dispute resolution) will survive termination.
12. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall be subject to the exclusive jurisdiction of the courts of Nigeria, unless mandatory consumer law provides otherwise.
13. Changes
We may update these Terms. We will post changes on this page and update the effective date. Material changes may be notified in the app. Continued use constitutes acceptance.
